New York Moving Violations Points and Fines

UPDATED POINT SYSTEM AS OF 2026:

As of January of 2026, the NY DMV will be changed it's point system.  Notably, some violations, as will be explained below, which carried no points, will now carry points and some violations have had their point total increased.

Also, the 11 points on the license in 18 points used to trigger a suspension, however under the new rules, 10 points in 24 months will trigger a suspension New York State.

Futhermore, the NY DMV will now has the discretion to summons a driver in for a formal Habitual and Persistent Offender Hearing. The following scenarios will trigger being called to such a hearing:  1)  Having more than 9 points for speeding tickets.  2) Getting more than 4 points within a year after having a such a hearing.  3) Getting convicted of 3 or more tickets in a short amount of time, which is not defined, btw!

Points for the following NY tickets are being increased.

VTL §600- Leaving the Scene of an Accident
Leaving the scene of an accident previously carried three points. It will now result in five points.


Now eight points, regardless of the speed and regardless of the speed limit. Automatic Driver’s Responsibility Assessment Fee.

VTL §1129 - Following too closely: Once four points, will now be five points.
VTL §1146 - Failure to Use Due Care: This violation is now five points.
VTL §1151-a - Failure to Yield to Pedestrians: Once three points, will be four points.
VTL §1212 - Reckless driving:
Will go up from five points to eight points. Reckless driving remains a misdemeanor with the previously established criminal penalties.

VTL §1174 - Overtaking or Passing a School Bus
Previously five points, this violation now carries eight points. A conviction of this violation alone will push a driver dangerously close to suspension, as well as trigger the Driver Responsibility Assessment Fee payable to the DMV.

VTL §1225 - Cell Phone Tickets
Previously five points, it will now be six points. This will automatically trigger the Drivers Responsibility Assessment Fee, even if there are no other points on a driver’s license.

VTL §385 - Overheight Vehicle Violations
In the interest of protecting bridges, the DMV has now attached eight points to this offense. A truck that strikes a bridge due to its height will result in the driver incurring steep points, as well as a Driver’s Responsibility Assessment Fee.

VTL §511 - Aggravated Unlicensed Operation
VTL 511 is a misdemeanor. It carries an authorized sentence of imprisonment and many hundreds of dollars in fine, as well as a criminal record. However, it previously carried 0 points. If a person was convicted of VTL §511 prior to the enacted changes, they would still have no points on their license.

The November 6 passage did away with this. Conviction of VTL §511 will result in 11 points on a driver’s license, which will trigger a subsequent suspension. It will also result in a Driver’s Responsibility Assessment Fee.

VTL §511(a)(1)- Facilitating Aggravated Use of Unlicensed Operation
Facilitating an AUO previously carried 0 points though it appeard on your driving abstract. Now it wil carry five points.

VTL §1182 - Speed Contests/Racing
VTL §1182 similarly is a misdemeanor offense. Under the new rules, it will now carry five points.

VTL §1192.1-§1192.4 - DUI/ DWAI
Similar to driving with a suspended license, driving under the influence is a misdemeanor. While it carried criminal and collateral consequences, it did not impose any points on a person’s license. A person convicted of a DUI would have no points on their license

DUI’s will now carry 11 points. This will result in suspension with the DMV, separate from any suspensions that can be issued by the Court.

A person with five or more drug or alcohol convictions on their record was subject to a lifetime re-licensing restriction. The number of these convictions has since decreased to four.

If you incur six points on your driver record during a period of 18 months, the annual assessment is $100. The minimum amount that you must pay each year is the annual assessment. The total assessment for the three years is $300. If you incur more than six points on your driver record during a period of 18 months, the annual assessment is $25 for each point more than the original six points. The minimum amount that you must pay each year is the annual assessment. The total assessment for the three years is $75 for each point more than the original six points.  You can reduce your driver violation point total and your insurance premiums, but completion of a 
POINT REDUCTION COURSE does not change your driver responsibility assessment!

(a) All traffic Search Term Begin violations Search Term End shall be assigned a point value of two points, except as otherwise prescribed in subdivision (b) of this section.

(b) Exceptions. 

(1) The following Search Term Begin violations Search Term End shall be assigned a point value of 11 points:

(i) any Search Term Begin violation Search Term End involving Search Term Begin speeding Search Term End more than 40 miles per hour over the Search Term Begin speed Search Term End limit.

(2) The following Search Term Begin violations Search Term End shall be assigned a point value of eight points:

(i) any Search Term Begin violation Search Term End involving Search Term Begin speeding Search Term End more than 10 but not more than 20 miles per hour over the Search Term Begin speed Search Term End limit;

(ii) following too closely; and

(iii) inadequate service brakes, except for such a Search Term Begin violation Search Term End committed by an employed driver during the course of his employment, which shall be subject to the provisions of subdivision (a) of this section.

(6) The following Search Term Begin violations Search Term End shall be assigned a point value of three points:

(i) any Search Term Begin violation Search Term End involving Search Term Begin speed Search Term End except where a different point value has been assigned;

(ii) any Search Term Begin violation Search Term End constituting a failure to yield the right-of-way;

(iii) any Search Term Begin violation Search Term End involving a railroad crossing, disobeying a traffic control signal or a stop or yield sign;

(iv) any Search Term Begin violation Search Term End involving improper passing, changing lanes unsafely, driving Best Section End to left of center of roadway, or driving in the wrong direction;

(v) leaving the scene of a property damage incident or injury to an animal without reporting; and

(vi) any Search Term Begin violation Search Term End involving use of safety belts or seats by a child under the age of 16.

(7) The following Search Term Begin violations Search Term End shall not be assigned any point value:

(i) any Search Term Begin violation Search Term End relating to vehicle registration, licensing or insurance;

(ii) any Search Term Begin violation Search Term End relating to Search Term Begin motor vehicle Search Term End inspection, vehicle weights or dimensions or vehicle equipment other than inadequate service brakes;

(iii) any Search Term Begin violation Search Term End for which suspension or revocation action is mandated upon conviction;

(iv) any parking Search Term Begin violation Search Term End ;

(v) any pedestrian or bicycle Search Term Begin violation Search Term End ;

(vi) any Search Term Begin violation Search Term End relating to a business or the sale of goods established in the Vehicle and Traffic Law or any local law;

(vii) any other Search Term Begin violation Search Term End not resulting from the operation of a Search Term Begin motor vehicle Search Term End ;

(viii) any Search Term Begin violation Search Term End of section 1110(a) of the Vehicle and Traffic Law relative to the improper use of high occupancy vehicle lanes in Suffolk County, between exits 49 and 57 of the Long Island Expressway; and

(ix) any Search Term Begin violation Search Term End of section 1225-c of the Vehicle and Traffic Law involving the use of a mobile phone.

(8) Point values for Search Term Begin violations Search Term End committed on or after July 1, 1988 shall be assigned in accordance with the provisions of this section which became effective on October 12, 1988.

(c) Point values assessed shall be assessed as of the date of Search Term Begin violation Search Term End .

Some Recent Traffic and Criminal Court Success Stories

Spring Valley Justice Court:  CRIMINAL DWI - DISMISSED!
